Terms & Conditions

These Terms of Service (“Terms”) govern the purchase and use of services provided by BlakkBrikk Pool Co. (“BlakkBrikk Pool Co.,” “COMPANY,” “we,” “us,” or “our”) to the customer identified on an invoice, estimate, service agreement, or other customer record (“CUSTOMER,” “you,” or “your”).

These Terms apply to services provided by BlakkBrikk Pool Co., including pool cleaning, pool maintenance, pool repairs, equipment service and upgrades, pool remodeling, pool cover services, water treatment, and other pool-related services we may offer from time to time (collectively, the “Services”).

CUSTOMER and COMPANY may each be referred to as a “Party” and collectively as the “Parties.”

These Terms explain the obligations of BlakkBrikk Pool Co. and the obligations of the CUSTOMER in connection with the Services.

By requesting, scheduling, purchasing, or using our Services, you acknowledge that you have had the opportunity to review these Terms and agree to be bound by them, together with any applicable estimate, invoice, service agreement, proposal, or other written terms provided by BlakkBrikk Pool Co.

Services

BlakkBrikk Pool Co. provides residential and other pool-related services, which may include:

  • Pool cleaning
  • Pool maintenance
  • Water chemistry and balancing
  • Pool repairs
  • Pool equipment service and upgrades
  • Pool remodeling
  • Pool cover services
  • Equipment inspections and troubleshooting
  • Filter cleaning
  • Specialty treatments
  • Other pool-related services offered by BlakkBrikk Pool Co.

The specific Services provided to CUSTOMER will depend on the service package, estimate, proposal, invoice, or other agreement applicable to the CUSTOMER.

Not every service is included in every service package.

Services that fall outside the agreed scope of work may be subject to additional charges.

Service Packages and Scope of Work

Recurring pool service packages are based on the size, condition, equipment, usage, and estimated time required to properly service the pool.

The Services included in CUSTOMER’s selected package will be communicated before service begins and may be identified on the CUSTOMER’s invoice, estimate, proposal, or service agreement.

Unless expressly included in the selected service package, additional services, repairs, replacement parts, specialty treatments, equipment work, filter cleanings, remodeling work, and other Services may be billed separately.

BlakkBrikk Pool Co. reserves the right to recommend additional Services when reasonably necessary to maintain the condition, safety, operation, or performance of a pool or its equipment.

Recommendations do not automatically authorize additional work unless authorization is provided as required under these Terms or the applicable service agreement.

Recurring Pool Service

For recurring pool cleaning or maintenance customers, service will generally be performed according to an established service schedule communicated by COMPANY.

The exact day and time of service may vary due to routing, weather, holidays, staffing, emergency work, seasonal conditions, or other operational circumstances.

BlakkBrikk Pool Co. does not guarantee an exact arrival time unless expressly agreed to in writing.

CUSTOMER may request a change to the service schedule; however, requested schedule changes are subject to availability and may not always be accommodated.

The frequency of recurring service will be based on the service package selected by CUSTOMER.

If CUSTOMER requests an increase, decrease, temporary suspension, or other change to recurring service, COMPANY may require advance notice and may approve or decline the requested change based on scheduling and operational requirements.

Property Access

CUSTOMER is responsible for ensuring that BlakkBrikk Pool Co. has reasonable and safe access to the pool, equipment, gates, property, and other areas necessary to perform the Services.

CUSTOMER is responsible for providing any necessary:

  • Gate codes
  • Access codes
  • Keys
  • Lock combinations
  • Security instructions
  • Property access instructions
  • Other information reasonably necessary for access

CUSTOMER is also responsible for ensuring that pets are secured when necessary and that technicians can safely access the service area.

If COMPANY is unable to access the property or service area because of locked gates, inaccessible areas, construction, pets, security restrictions, unsafe conditions, or other circumstances within CUSTOMER’s control, the Service may be skipped, delayed, or rescheduled.

A missed service resulting from CUSTOMER’s failure to provide reasonable access may not be eligible for a credit or refund.

BlakkBrikk Pool Co. is not responsible for unlocking, repairing, maintaining, or securing CUSTOMER’s gates, fences, locks, or other access equipment unless such work has been specifically agreed upon as a paid Service.

Customer Responsibilities

CUSTOMER is responsible for providing accurate information regarding the property, pool, equipment, and requested Services.

CUSTOMER is responsible for maintaining reasonable pool conditions between service visits, including maintaining appropriate water levels when required for proper equipment operation.

CUSTOMER should promptly notify COMPANY of known problems involving pool equipment, plumbing, electrical systems, structural components, leaks, water loss, or other conditions that may affect the Services.

CUSTOMER is responsible for notifying COMPANY if any chemicals, treatments, equipment changes, repairs, or other modifications have been made to the pool between service visits.

Failure to maintain required conditions or disclose relevant information may affect water chemistry, equipment operation, service results, and the cost or scope of additional Services.

Water Chemistry and Chemicals

BlakkBrikk Pool Co. may test and adjust pool water chemistry as included within the CUSTOMER’s selected service package.

Chemical requirements may vary depending on weather, pool usage, water conditions, equipment, environmental conditions, and other factors.

CUSTOMER must notify COMPANY if CUSTOMER or another person adds chemicals or other substances to the pool between service visits.

COMPANY is not responsible for water chemistry problems, damage, or other conditions resulting from chemicals or treatments added by CUSTOMER or another party without COMPANY’s knowledge.

Certain chemical treatments, specialty chemicals, algae treatments, stain treatments, phosphate treatments, or other specialty services may not be included in recurring service packages and may result in additional charges.

Repairs and Additional Work

Repairs, equipment work, specialty treatments, additional maintenance, remodeling, replacement parts, and other Services outside the CUSTOMER’s agreed service package may be billed separately.

When additional work is identified, COMPANY may provide CUSTOMER with an estimate, proposal, or other description of the recommended work and associated charges.

CUSTOMER authorization may be required before additional work is performed.

In situations where immediate action is reasonably necessary to prevent further damage to pool equipment, property, or other components, COMPANY may communicate the recommended action and applicable charges as soon as reasonably practicable.

CUSTOMER understands that pool repairs may reveal additional defects, deterioration, damage, or equipment conditions that were not reasonably apparent before work began.

An estimate is based on the information and conditions reasonably known at the time it is prepared. If conditions materially change or additional work is required, COMPANY may provide a revised estimate or additional authorization request.

Equipment and Existing Conditions

Pool equipment and components naturally deteriorate over time due to age, chemical exposure, weather, corrosion, normal wear, improper installation, environmental conditions, and use.

BlakkBrikk Pool Co. is not responsible for the failure of existing equipment or components that were not caused by COMPANY’s Services.

CUSTOMER acknowledges that servicing or repairing an existing system may reveal pre-existing defects or conditions.

COMPANY may recommend replacement, repair, upgrades, or other corrective work when equipment or components are damaged, worn, outdated, unsafe, or otherwise unsuitable for continued operation.

Filters, Equipment, and Specialty Services

Filter cleaning, equipment maintenance, specialty treatments, and other additional maintenance may be recommended based on the condition and needs of the pool.

Failure to authorize recommended maintenance may contribute to poor water quality, algae growth, equipment problems, increased chemical usage, or other conditions.

Any additional labor, chemicals, replacement parts, or Services required as a result may be billed separately.

Algae, Debris, and Environmental Conditions

Pool water and surfaces may be affected by algae, pollen, leaves, vegetation, weather, rain, wind, dust, landscaping, animals, pool usage, and other environmental conditions.

Certain types of algae and contaminants may be introduced through swimmers, clothing, pool equipment, floats, toys, animals, environmental exposure, or contact with other bodies of water.

Standard recurring service does not guarantee that a pool will remain completely free of algae, debris, stains, or other environmental conditions between service visits.

Specialty treatments or additional cleaning may be required to address certain conditions and may result in additional charges.

Weather, Holidays, and Uncontrollable Events

BlakkBrikk Pool Co. may modify, delay, reschedule, partially perform, or suspend Services due to severe weather, unsafe conditions, natural disasters, emergencies, road conditions, power outages, property conditions, supply issues, staffing limitations, or other circumstances outside our reasonable control.

If weather or other conditions prevent full service, COMPANY will make reasonable efforts to perform the Services to the extent reasonably possible.

A partial service or missed service resulting from circumstances outside COMPANY’s reasonable control may not be eligible for a credit or refund.

Following significant storms, flooding, freezes, or other natural events, additional cleanup, repairs, chemical treatment, or equipment work may be required before normal recurring service can resume. Such work may be subject to additional charges.

Holiday schedules may be adjusted and Services may be performed before or after the CUSTOMER’s normal service day.

Pricing and Estimates

Pricing is based on the Services requested, the condition and characteristics of the pool, estimated labor, materials, equipment, service frequency, and other relevant factors.

The applicable price will be communicated to CUSTOMER through an estimate, proposal, invoice, service agreement, or other written communication.

Unless otherwise stated in writing, estimates are not guarantees of the final cost when conditions change or additional work is required.

COMPANY reserves the right to modify pricing for recurring Services when reasonably necessary due to changes in labor, materials, chemical costs, service requirements, operating costs, or other business conditions.

CUSTOMER will receive notice of applicable pricing changes where required.

Payments and Billing

CUSTOMER agrees to pay all invoices, charges, deposits, and other amounts owed to COMPANY according to the payment terms provided at the time of purchase or service.

Online payments may be processed through third-party payment processors. BlakkBrikk Pool Co. does not directly store complete payment card information on our website or systems unless expressly stated otherwise.

CUSTOMER is responsible for providing accurate payment and billing information.

If a payment is declined, reversed, disputed, or otherwise unsuccessful, COMPANY may suspend or delay Services until the outstanding balance is resolved.

Any applicable late fees, returned-payment fees, cancellation fees, deposits, or other charges will be disclosed to CUSTOMER when applicable.

COMPANY reserves the right to suspend or discontinue Services for overdue or unpaid balances.

Cancellations and Service Termination

CUSTOMER may request cancellation of recurring Services in accordance with the cancellation terms applicable to the CUSTOMER’s service agreement.

COMPANY may terminate or suspend Services for reasons including, but not limited to:

  • Unpaid balances
  • Repeated inability to access the property
  • Unsafe working conditions
  • Abusive, threatening, or inappropriate conduct
  • Repeated refusal to authorize necessary work
  • Conditions that prevent COMPANY from safely or reasonably providing the Services
  • Other material violations of these Terms

Upon termination, CUSTOMER remains responsible for any unpaid amounts, completed Services, approved work, materials, cancellation charges, or other amounts properly owed to COMPANY.

Property, Pets, and Safety

CUSTOMER is responsible for maintaining a reasonably safe working environment for COMPANY personnel.

CUSTOMER should secure pets and animals when necessary to allow technicians to safely perform Services.

COMPANY is not responsible for pets or animals that enter the service area, consume pool water or chemicals, interfere with Services, damage pool equipment, or otherwise interact with the pool or equipment.

COMPANY may refuse or discontinue Services if technicians encounter conditions that reasonably present a safety risk.

Damage and Pre-Existing Conditions

COMPANY will exercise reasonable care when performing Services.

However, COMPANY is not responsible for damage resulting from pre-existing conditions, normal deterioration, defective or improperly installed equipment, structural deficiencies, corrosion, weather, acts of nature, vandalism, misuse, abuse, unauthorized modifications, or conditions outside COMPANY’s reasonable control.

CUSTOMER is responsible for maintaining structures, landscaping, fencing, gates, electrical systems, plumbing, equipment, and other property components that are outside the agreed scope of COMPANY’s Services.

Customer Complaints and Service Concerns

CUSTOMER should promptly contact COMPANY if there is a concern regarding the quality, completeness, timing, or performance of a Service.

Whenever reasonably possible, service concerns should be reported promptly after the applicable Service so that COMPANY has an opportunity to investigate and address the issue.

Nothing in this section limits any rights CUSTOMER may have under applicable law.

Warranties

Any warranty applicable to a particular Service, repair, product, part, or installation will be provided to CUSTOMER in the applicable estimate, invoice, proposal, service agreement, manufacturer documentation, or other written communication.

Manufacturer warranties are subject to the applicable manufacturer’s terms and conditions.

Unless expressly provided in writing or required by applicable law, COMPANY does not provide warranties beyond those expressly stated.

Limitation of Liability

To the fullest extent permitted by applicable law, BlakkBrikk Pool Co. will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to the Services, website, or these Terms.

This includes, where permitted by law, losses arising from business interruption, loss of use, loss of profits, loss of goodwill, or other indirect damages.

COMPANY’s liability, if any, arising from a Service will be limited to the amount paid by CUSTOMER for the specific Service giving rise to the claim, except to the extent such limitation is prohibited by applicable law.

Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited.

Indemnification

To the fullest extent permitted by applicable law, CUSTOMER agrees to indemnify and hold harmless BlakkBrikk Pool Co., its owners, employees, contractors, representatives, and service personnel from claims, liabilities, damages, losses, costs, and expenses arising from CUSTOMER’s misuse of the Services, violation of these Terms, unauthorized modifications to the pool or equipment, or actions or omissions that cause damage or injury.

This section does not apply to the extent that the claim results from conduct for which COMPANY is legally responsible.

Website Use

The BlakkBrikk Pool Co. website and online services are provided for lawful purposes.

CUSTOMER agrees not to:

  • Use the website for unlawful or fraudulent purposes
  • Submit false or misleading information
  • Attempt to gain unauthorized access to our systems
  • Interfere with the operation or security of the website
  • Copy or reproduce website content without authorization
  • Use automated systems in a manner that interferes with the website or our systems

COMPANY reserves the right to restrict or terminate access to the website where reasonably necessary.

Electronic Communications

CUSTOMER agrees that COMPANY may communicate with CUSTOMER electronically regarding inquiries, estimates, appointments, Services, invoices, payments, account information, and other business matters.

Electronic communications may include email, text messages, online notifications, or other communication methods provided by CUSTOMER.

Marketing communications are subject to applicable consent requirements and our Privacy Policy.

Privacy

Your use of our website and Services is also subject to our Privacy Policy.

Our Privacy Policy explains how BlakkBrikk Pool Co. collects, uses, discloses, and protects personal information.

The Privacy Policy is incorporated into these Terms by reference.

Third-Party Services

BlakkBrikk Pool Co. may use third-party platforms, technology providers, payment processors, communication services, analytics tools, advertising platforms, and other service providers to operate and support our business.

These services may assist us with functions including website and funnel hosting, online payments, appointment and service communications, email and text messaging, marketing, advertising, analytics, customer communications, and other business operations.

When you interact with our website, submit a form, request a quote, make a payment, communicate with us, or otherwise use our Services, certain information may be processed by these third-party service providers as necessary to provide the requested service or operate our business.

BlakkBrikk Pool Co. selects service providers that we believe are appropriate for the functions they perform. However, third-party providers operate under their own terms, privacy policies, and security practices, and COMPANY does not control the independent practices of third parties.

We do not authorize third-party service providers to use your personal information for purposes unrelated to the services they provide to or on behalf of BlakkBrikk Pool Co., except as otherwise permitted by applicable law or disclosed in our Privacy Policy.

Our use of third-party services does not change your rights under our Privacy Policy or applicable law.

Changes to These Terms

BlakkBrikk Pool Co. reserves the right to modify, amend, replace, or update these Terms of Service at any time and at our discretion.

Changes will become effective when the revised Terms are posted on this website, unless otherwise required by applicable law.

We may update these Terms to reflect changes in our business, Services, technology, pricing, operating practices, or legal and regulatory requirements.

The updated version will include a revised “Updated” date.

CUSTOMER is responsible for reviewing the most current version of these Terms.

Continued use of the Services after updated Terms have been posted constitutes CUSTOMER’s acknowledgment and acceptance of the revised Terms to the extent permitted by applicable law.

Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

Any dispute arising from or relating to these Terms or the Services will be handled in accordance with applicable Texas law and in a court of competent jurisdiction.

Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be modified or limited to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force and effect to the fullest extent permitted by law.

Entire Agreement

These Terms, together with any applicable estimates, proposals, invoices, service agreements, written approvals, and other agreements between CUSTOMER and COMPANY, constitute the agreement governing the Services.

If there is a conflict between these Terms and a specific written service agreement or proposal, the specific written agreement will control with respect to the Services described in that agreement.
